1. The service
Wyndow provides weather and ocean-related information, forecasts, spot discovery, optional account features, subscription tiers, in-app and push notifications (we may add other channels such as email in the future), and (on eligible plans) an AI assistant called Kairos that answers questions using our infrastructure and, where enabled, your profile and context. Optional personalized services—such as tailored alerts, notifications, or recommendations—run only when you turn on the relevant settings and may use data you have saved (for example gear, skill, favorites). Features vary by plan and platform. We may change, limit, or discontinue parts of the service with reasonable notice where practicable.
2. Subscriptions, billing, and renewal
We offer multiple plans (including Local, Explorer, and Navigator). Limits such as number of saved spots, forecast horizon, geographic coverage, alert sophistication, and access to Kairos depend on your active subscription. Plan details shown in the app or checkout at the time you subscribe apply.
2.1 Subscription length and billing period
Paid plans are offered for a recurring billing period (for example monthly or yearly) as shown when you choose a plan. The period starts when your purchase is confirmed. Unless you cancel as described below, your subscription renews automatically for the same length at the end of each period. The price and currency shown at checkout or in the App Store apply to that purchase; taxes may apply where required by law.
2.2 Auto-renewal and payment
Auto-renewal. Subscriptions renew automatically unless you turn off renewal before the current period ends. You authorise us (or our payment partner) to charge the applicable fee for each renewal period.
- Web (Stripe). If you subscribe on the Wyndow web app, payment is processed by Stripe. You can manage payment methods, change plan, or cancel renewal through the billing portal linked from your account (Profile → Plan or Settings, as shown in the product). Cancellation stops future charges; paid features typically remain until the end of the current billing period unless the product states otherwise.
- iOS (Apple). If you subscribe in the Wyndow iOS app, payment is charged to your Apple ID. Subscriptions auto-renew unless you cancel at least 24 hours before the end of the current period. Apple may charge your account for renewal within 24 hours before the period ends. Manage or cancel in Settings → Apple ID → Subscriptions(or the manage-subscription flow shown in the app). Apple's terms and refund rules apply to App Store purchases.
- Admin-granted access. We may grant paid access without Apple or Stripe billing (for example support, pilots, or promotions). That access follows the dates and plan shown in the product and does not create a recurring charge until you subscribe through a store or checkout yourself.
You are responsible for keeping payment details current where you control them (Stripe or Apple). One Wyndow account must not be shared to circumvent plan limits or billing.
2.3 Free trials and introductory offers
We may offer a free trial or introductory price for eligible plans. If offered, the trial length and what happens when it ends (including conversion to a paid subscription at the displayed price) are shown before you confirm the offer. Unless you cancel before the trial ends, you may be charged automatically when the trial converts to a paid period. Store-specific rules (Apple or Stripe) apply to how trials are presented and billed.
2.4 Downgrades, cancellation, and refunds
Downgrades and cancellation. You may move to a lower tier or cancel renewal using the flows above (Stripe billing portal, App Store subscriptions, or as shown in the app). Downgrades or cancellations may reduce features immediately or at the end of the current billing period, as shown in the product. Deleting your Wyndow account does not by itself cancel an Apple or Stripe subscription—you must cancel renewal with Apple or Stripe where applicable.
Refunds. Fees are generally non-refundablefor partial billing periods except where required by mandatory law or by the payment platform's policies (for example Apple's refund process for App Store purchases). Contact hello@wyndow.surf if you believe a charge was made in error.
2.5 Changes to plans and pricing
We may add, rename, combine, or retire subscription tiers; change included features or limits; and change prices, bundles, or promotions for new purchases or renewals, in each case as shown in the product or checkout when you subscribe or when a renewal is charged. Nothing in these Terms locks us into a permanent price or feature set. Mandatory consumer laws still apply (for example rules on advance notice, renewal consent, or cancellation before a price increase)—where the law gives you rights, those rights control over any general wording here.
3. Accounts and eligibility
You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. You must not share accounts in a way that circumvents limits or billing. We may suspend or terminate accounts that violate these Terms or pose risk to the service or other users.
4. Alerts and notifications
If you enable spot alerts, push and in-app notifications, or other channels we make available, you instruct us to send messages based on conditions you configure and data we process. Delivery is not guaranteed (carriers, device settings, and third-party services can affect delivery). You can turn alerts off in the app or system settings. Alerts are informational only and do not replace your judgment on the water.
5. Kairos, AI features, and how you use them
What counts as AI use.When you use Kairos or other AI-powered parts of Wyndow, your messages and (if you enable personalization) related profile and context are transmitted to our systems and, where needed, to subprocessors that run machine-learning models ("AI consumption"). We apply limits (for example rate or fair-use caps) to keep the service reliable for everyone; we do not guarantee uninterrupted AI availability or a particular model or provider at all times.
Language. The Wyndow interface and Kairos are provided in English only. We do not warrant that Kairos will behave reliably, safely, or accurately if you use other languages; assistant outputs are intended for English prompts and replies.
Voice and read-aloud.Optional voice input sends audio from your device to us for transcription into text, as described in the Privacy Policy. Read-aloud of assistant messages normally uses your device's own text-to-speech; we typically do not receive that audio. Do not use voice input in unsafe situations (for example while driving or on the water) if it distracts you.
Intended use of Kairos. Kairos is meant for topics tied to wind and water sports (such as kitesurfing, windsurfing, wingfoiling, surfing, or similar), spots and sessions, travel to ride, and weather, ocean, and conditions that matter for those activities. Do not use Kairos as a general chatbot for unrelated subjects (for example legal, medical, or financial advice; homework; politics; or bulk content generation). We may refuse, truncate, or stop responding to misuse and may take account action for serious or repeated abuse.
Chats and context ("memory"). Kairos may rely on stored messages from your current or recent conversations so replies stay coherent across turns or when you return to the app—what we or the product may call memory refers to that technical context, not a perfect or permanent record of facts about you. Avoid putting passwords, payment card numbers, or other highly sensitive information in chat.
Outputs are not facts or instructions. Kairos and similar features generate text or suggestions automatically. That output may be wrong, incomplete, biased, or outdated. It is not professional meteorological, maritime, legal, medical, rescue, or safety advice.
Scores and recommendations.Features such as condition scores, "best time" hints, spot ordering, alert wording, and Kairos answers are informational suggestions only. They are not a recommendation that you should go on the water, travel to a spot, or attempt a session. Personalization (when enabled) may change what you see; that does not make any suggestion safer or more suitable for you. You must always confirm conditions, hazards, rules, and your own readiness on site.
Your decisions. You remain solely responsible for every decision before and during activities such as kitesurfing, wingfoiling, surfing, or boating. Do not rely on Wyndow, forecasts, scores, alerts, or AI output as your only source of safety-critical information. Where the product offers controls (for example limiting personalization), your choices affect how much context we use; see the Privacy Policy for data practices.
Public sessions and share links. If you publish a logged session to the community feed or create a share link, you grant Wyndow permission to display the published fields (such as spot, time, description, gear, and optional photo or track preview on share images) to other users or link visitors. You confirm you have the right to share that content and that publishing location-related data is your choice. You can unpublish or disable share links from the app. We may remove published content that violates these Terms or applicable law.
6. Assumption of risk; responsible and safe riding
You acknowledge that wind and water sports are inherently dangerous and can cause serious injury or death. Wyndow does not supervise, coach, or rescue you. By using the service you agree that you alone are responsible for riding responsibly and safely, including (without limitation):
- Assessing your fitness, skill level, and equipment for the actual conditions at the time and place you ride;
- Obeying local laws, beach and waterway rules, right-of-way, restricted zones, and instructions from lifeguards or authorities;
- Checking real-world conditions on location (wind, waves, currents, tide, obstacles, other users) and changing or abandoning your session if conditions exceed your ability or are unsafe;
- Using appropriate safety practices (for example suitable leash, flotation where appropriate, buddy or beach-aware protocols where prudent) and not riding impaired;
- Not treating any forecast, alert, score, map, or AI message as permission or encouragement to ride in dangerous conditions.
Nothing in Wyndow replaces training, local knowledge, or your own judgment. If you are unsure, do not go out.
7. Weather data and third parties
Forecasts and observations come from third-party providers and models. We do not warrant accuracy, availability, or fitness for a particular purpose. Displayed units and conversions follow our product configuration; always verify critical values independently.
8. Acceptable use and fair use
You agree not to misuse Wyndow: no scraping or automated access beyond normal app use without permission, no attempt to probe or break security, no interference with other users, no unlawful use, and no redistribution of our service or data in bulk in violation of provider terms. You will comply with applicable export and sanctions laws.
Fair use of the service. Wyndow is for personal use in line with your plan. You must not impose unreasonable load on our infrastructure or third-party providers—for example by excessive automated requests, trying to circumvent usage or geographic limits, sharing one paid account to pool usage across many people, or operating the product in a way that could degrade performance for others. We may apply rate limits, queues, or caps (including for API calls, alerts, and AI features), monitor aggregate patterns, and suspend or terminate access where we reasonably believe fair use is breached or the service is being abused.
9. Intellectual property
Wyndow, its branding, software, and content we create are owned by us or our licensors. We grant you a limited, personal, non-exclusive licence to use the service as intended. You receive no ownership rights in our IP or in third-party weather data beyond what those providers allow through normal use of Wyndow.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM IMPLIED WARRANTIES INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. OUTDOOR SPORTS CARRY INHERENT RISK; YOU USE WYNDOW AT YOUR OWN RISK.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WYNDOW AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THAT PERIOD OR (B) ONE HUNDRED EUROS (€100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER MANDATORY LAW.
12. Changes
We may update these Terms. We will post the new version on this page and update the "Last updated" date. Material changes may require additional notice or consent where required by law. Continued use after changes take effect constitutes acceptance unless applicable law requires otherwise.
